Challenge

The need for operational support of key personnel abroad

In the early days of the full-scale Russian invasion of Ukraine, our client faced the urgent need to mitigate risks and ensure uninterrupted business operations. Initially, key developers were evacuated from Ukraine for 2-3 weeks. However, as the conflict continued, it became clear that a longer-term solution was necessary. Team members, along with their families, relocated worldwide, spanning Europe, North and South America, the Caucasus, and the Middle East. Concurrently, the client decided to recruit new talent outside Ukraine, targeting skilled technical professionals in India, Poland, Romania, Bulgaria, Latvia, and other countries.

To swiftly implement these critical tasks, our client required unique expertise and support in managing a range of complex administrative processes. These included negotiating and drafting B2B contracts compliant with various labor and tax laws, providing guidance on international tax regulations, offering accounting and legal support for Ukrainian contractors abroad, and ensuring timely and accurate compensation payments in multiple currencies and countries.

Comprehensive support for compliance, B2B contracting, and international recruitment

We provided our client with comprehensive payroll support, ensuring meticulous and timely compensation for their team, which had been dispersed across over 15 countries in the initial months of the conflict, all while adhering to international labor laws.

  • Compensation System: We developed a compensation calculation system based on data from the client’s accounting registers.
  • Seamless Payments: Organized an uninterrupted payment process according to the client’s contractor register in USD, EUR, and UAH, offering flexible payment methods and currency choices.
  • Additional Compensation: Facilitated extra compensations, such as payments for sick days, paid leave guaranteed by long-term contracts, or reimbursement of representative expenses. These payments are made upon the client’s request, with final settlements conducted once a month.
  • Health Insurance Management: Managed all tasks related to arranging health insurance for employees and their families, including selecting insurance companies and optimal plans.
  • Personalized Support: Assigned personal managers to the client’s contractors, providing ongoing informational support and consultation on salaries and employment-related benefits.
  • Accounting Assistance: Provided continuous accounting support for Ukrainian contractors concerning taxation and reporting abroad, account management, and choosing optimal tax jurisdictions.
  • Tax Law Guidance: Maintained constant communication with the client’s contractors, clarifying nuances of tax residency in different countries, helping navigate complex topics such as controlled foreign companies (CFCs), and guiding registration and reporting under CFC rules.

Simultaneously, we created and launched a comprehensive accounting and reporting system, offering expert services including:

  • Contract Management: Accounting for civil-law contracts (e.g., mandate contracts, specific work contracts, management contracts).
  • Payslip Preparation: Generating and distributing payslips.
  • Payment Orders: Preparing payment orders for salary disbursements and state fees.
  • Social and Medical Insurance Reporting: Providing reports to employees on social and medical insurance contributions.
  • Accounting and Management Reporting: Preparing reports for accounting and management purposes.
  • Government Reporting: Preparing reports for government authorities regarding employee payments.
  • Auditor Interaction: Coordinating with the client’s auditors, social security agencies, and tax authorities, including support during tax audits, social security inspections, and labor inspections.

Additionally, we assembled a dedicated team of sourcers and recruiters to bolster the client’s internal recruitment efforts for hiring technical specialists abroad. In the first year of our collaboration, the geographic range of the client’s new employees expanded to over 20 countries. We carefully selected new team members, considering all of the client’s requirements regarding professional expertise and local experience.

We manage the entire B2B contract process, from negotiations and contract drafting to reviewing terms of cooperation and making necessary adjustments, such as updating banking details or clarifying local legal specifics.

We ensure timely and accurate payments to all B2B contractors in over 25 countries and handle all communication regarding any payment process nuances. Even if a contractor makes an error in their banking details, our specialists promptly identify and correct it. All payments are made on the agreed schedule, often ahead of time.

Each contractor is assigned a personal manager who provides individual assistance for any inquiries, including contract amendments, invoice issuance, payment execution and confirmation, preparation of bank receipts, and resolving potential delays due to international banking system intricacies.
